Divorce & Separation
Australia has a no-fault divorce system, meaning the Court does not consider why the marriage ended. The only ground for divorce is an irretrievable breakdown of the relationship, demonstrated by at least 12 months of separation. Legal separation can occur even if both parties are living under the same roof.
Parenting Arrangements
After separation, decisions need to be made about who children will live with and how much time they’ll spend with each parent. The division of assets and debts after separation follows the principle of just and equitable distribution. This includes all property, such as real estate, superannuation, shares, and liabilities. Contributions (both financial and non-financial) and future needs are considered.
Binding Financial Agreements
BFAs (commonly known as prenuptial or postnuptial agreements) allow couples to set out how their property and financial resources will be divided in the event of separation. They can be made before, during, or after a marriage or de facto relationship.
De Facto Relationships
Australian family law also recognises de facto relationships, including same-sex relationships. If a de facto relationship ends, parties may apply to the Court for property and financial orders, provided certain criteria are met.
